ECD registration document checklist

These are the documents most districts ask for, and the office that issues each one. Your district may add to the list, so check the current list against this one at the counter. The application to the education department has no fee. The municipal clearances do, and gathering them is what turns registration into a job measured in months.

What it is

This is a tracking checklist for registering your crèche as a partial care facility. It lists every document the process asks for, names the office that issues each one, and gives you a column for the date you applied and the date it came back.

It is your own record. It is not a government form, and no official issues it. Its purpose is that when the district ECD official sits down at your table, you can answer every question on her list from one page instead of from three different files and a shoebox.

Who asks for it

The Children's Act 38 of 2005 is what makes registration compulsory. If you care for more than six children who are not your own, your premises is a partial care facility and it must be registered. Six or fewer and you are below the line. Seven and you are not.

Registration runs through your provincial education department. On 1 April 2022 early childhood development moved from the Department of Social Development to the Department of Basic Education. Your application goes to your education district office, to the official responsible for ECD registration in that district. Most of what you find online was written before the move.

You still deal with Social Development, but only for the Child Protection Register clearance. The registration itself and the subsidy run through education. There is one edge to watch. Partial care that is not an ECD programme, after-school care for older children for example, does not automatically sit with education. If that describes your centre, ask the district ECD official where your file belongs before you submit anything.

Almost nothing on this list is issued by the education department itself. Each item has its own office:

Environmental health usually sits at the district municipality, not the local one. Fire and town planning usually sit at the local municipality. Confirm both before you drive anywhere.

Get the application form from the district office itself. Ask the district ECD official for the current version and write down the date you were given it. Old forms circulate on WhatsApp for years after they are replaced, and a form from the wrong year gets your file handed back at the counter. Do not print one off a website you do not recognise.

On the expiry column. The two dates above are what those particular certificates happen to show. Do not assume a standard period for either. Read the expiry printed on your own certificate and copy that date across, and where nothing is printed, ask the issuing office in writing how long it stands.

Where this centre stands on day 197: 11 items complete, 5 outstanding. Four of the five outstanding items sit with an outside office, not with Nomsa. The two that are hers to fix are the corrected ID number on item 9 of the example above and two parent signatures on item 16 of the example above. Both can be done this week. The consent use approval and the building plan are what the file is waiting on, and both are municipal. Those two are also where the remaining money goes, in draughtsman fees and municipal charges. Notice that three of the five outstanding rows have nothing solid in the reference column. Those are the three she cannot chase properly over the phone.

What happens at inspection if you do not have it

The district ECD official does not arrive to catch you out. She arrives with a list and works down it. What happens when an item is missing depends entirely on which item it is.

You applied for it and it has not come back. Show the proof of application: the reference number, the date stamp, the receipt, the email. An official will accept "applied 5 February, reference TP/CU/26/1188, followed up 12 August." She will not accept nothing. This is the whole reason the reference number column exists.

You never applied for it. It goes onto the site visit report. You sign the report. You get a written notice with a date to fix it. The date is set by the official, item by item. Ask her to write it down in front of you and read it back, because that date is the one your file now runs on. Your application is not refused on the spot. It is held, and the follow-up visit gets scheduled at the district's convenience, not yours. That is where the months disappear.

Ask about conditional registration. Where the safety items are in place and the outstanding documents sit with another office, a district can register a centre subject to conditions and give a date to produce the rest. That is worth asking for by name at the site visit, because it is what moves a centre from waiting to operating.

You have it but you cannot find it. Same outcome as not having it. She cannot write down what she has not seen. This happens more often than a genuinely missing document, and it is the cheapest failure to fix.

What the delay costs. Until you are registered, including conditionally, there is no subsidy. Say your district approves 40 subsidised places at R24 per child per day attended. At full attendance across 22 days that is R21 120 in a month, and less in any month where children are absent or the centre closes. Assume the subsidy starts when your registration is approved and do not plan on it being paid for the months you spent waiting. Every month of avoidable delay is money you never claim back.

What registration actually costs you. The application to the education department has no fee. The municipal clearances do. A consent use application, building plan fees, a draughtsman and the police checks are where the money goes, and they are usually several thousand rand. Budget for the municipal side before you start, because that is the side that stalls centres.

What actually gets a centre closed. Not paperwork. A serious safety finding: a blocked fire exit, an unfenced pool, an injured child, food prepared in a kitchen the Environmental Health Practitioner will not sign off. The municipality can act on the health and fire side on its own, without waiting for the education department. Behind on documents means you are slow. Behind on safety means you are at risk. Do not treat the two the same way.

Common questions

Do I have to register if I only look after six children?

No. The Children's Act 38 of 2005 requires registration as a partial care facility when you care for more than six children who are not your own. Six or fewer and you are below that line. Seven and you are a partial care facility.

Why does everyone still tell me to go to Social Development?

Because ECD sat with the Department of Social Development until 1 April 2022. On that date the function moved to the Department of Basic Education. Registration and the subsidy now run through your provincial education department and its district ECD official. You still deal with Social Development, but only for the Child Protection Register clearance. Most of what you find online was written before the move.

How long does the whole process take?

There is no published turnaround, and it differs by district. Centres commonly describe three to nine months. The wait sits with zoning or consent use, building plan approval, fire clearance and the Certificate of Acceptability, and those are also where the money goes. The education department application has no fee, but a consent use application, building plan fees and a draughtsman usually run to several thousand rand. Apply for all four clearances in the same week rather than one after the other, and budget for the municipal side before you start.

Do I need a Certificate of Acceptability if I do not cook on site?

You need it where food is prepared or handled on the premises, and that includes warming food and plating it for children. If parents send sealed lunchboxes that no staff member opens or heats, ask the Environmental Health Practitioner at your district municipality to confirm in writing whether it applies to you. Get the answer on paper, not over the counter.
